Terms of Service

1. Entertainment Purposes Only

All content provided through our Services, including sports picks, analysis, and related insights, is for entertainment and informational purposes only.

We do not provide financial or investment advice. All decisions made using our content are at your own risk and discretion.

2. No Guarantees or Warranties

Our content is based on research and experience, but results are not guaranteed. Past performance does not represent future outcomes. You understand and agree that DFS and sports betting involve risk, and we are not responsible for any losses incurred from your actions.

3. Recurring Subscription & Billing Authorization

By completing your purchase, you agree that:

• You are enrolling in a recurring subscription that automatically renews at the stated interval (for example, every 2 days, weekly, or monthly).
• You authorize Sharpr Picks (B. Davis Management Inc.) and Whop.com to continuously charge your payment method until you cancel.
• You understand this charge will appear on your statement coming from Whop.com or its counterparts.
• You acknowledge that you are entering into a continuous payment authorization, which remains in effect until you terminate your subscription through your Whop account or by contacting official support.
• It is your responsibility to manage or cancel your subscription before the next billing date to avoid future charges.

This constitutes your explicit electronic consent to be billed automatically on a recurring basis until you cancel.

4. Access and Delivery of Picks

All purchases grant immediate access to our digital products via Whop.com. Once payment is complete, your subscription unlocks access to daily picks and exclusive content within the “Picks” tab of your Whop dashboard.

Picks are posted daily, and it is your responsibility to log in, familiarize yourself with the Whop.com interface, and access your content. Failure to view or utilize your access does not constitute non-delivery.

Once access is granted, you will always have full availability to the daily picks for as long as your subscription remains active. Delivery is considered complete and fulfilled once your Whop account is granted access to the Picks section.

4a. Sharpr Edge (Arbitrage Alerts)

Sharpr Edge is a separate subscription product and is not part of any picks membership. It delivers automated alerts identifying moments when two sportsbooks price the same event differently. It is not a pick, a prediction, a tip, or betting advice, and no one at Sharpr selects or handicaps the events involved.

• Billing. Sharpr Edge costs $149.00 per month. It is a recurring subscription that renews automatically every 30 days, charged through Whop.com, until you cancel it in your Whop account. Section 3 of these Terms applies to it in full.
• Delivery. An active subscription grants access to the Edge Alerts channel on Whop. Delivery is complete once your Whop account has access to that channel. Section 4 above, which concerns the daily picks product, does not describe this product.
• No money back guarantee. The guarantee in section 6a applies solely to the Sharpr Lifetime Membership and does not apply to Sharpr Edge. Section 6 governs instead: you may cancel at any time and retain access for the period already paid for.
• No guaranteed number of alerts. An alert only exists when sportsbooks actually disagree on price. We do not promise any volume, frequency, or minimum number of alerts, and there may be days on which none are sent.
• Prices move, and you verify them. Every alert is a snapshot of prices at the moment it is sent. You are responsible for confirming both prices at both sportsbooks before placing anything. Sharpr does not place, broker, or guarantee any wager.
• Sportsbook accounts are yours, and may be restricted. Sportsbooks routinely limit, restrict, void bets on, or close the accounts of customers who place bets of this kind. That is a known and expected consequence of the activity, is outside our control, and is not a defect in the product or a basis for a refund. Your relationship with each sportsbook is governed by that sportsbook's own terms, which you are responsible for reading.
• No profit is promised. Nothing in this product guarantees a profit. Section 2 and section 10 of these Terms apply to Sharpr Edge exactly as they apply to everything else.

5. Immediate Digital Delivery

Upon successful payment, you are granted instant access to digital products and/or private online communities. Because access is delivered immediately upon purchase, you waive any right to a “cooling-off” or cancellation period.

Delivery occurs as soon as login credentials, digital access, or product links are issued, whether or not you choose to access or download them.

6. All Sales Are Final

All sales are final and non-refundable, except where a refund is required by applicable law or where you qualify under the money back guarantee in Section 6a.

Except where required by applicable law, refunds, exchanges, and cancellations are generally not provided once access has been granted including, but not limited to:

• Accidental purchase
• Change of mind
• Dissatisfaction with results
• Failure to use the product

6a. Money Back Guarantee

Log every play we send. If you are not profitable after 6 months, we pay back what you paid for Sharpr Lifetime, up to $2,500.

The full conditions are below. They are conditions, not fine print: the tracking record is what makes the promise checkable, and without it we cannot tell a losing six months from an unfollowed one.

• SHARPR LIFETIME MEMBERSHIP ONLY. This guarantee applies solely to the Sharpr Lifetime Membership bought directly from Sharpr at full price. Every other product we sell or give away is final sale and carries no refund of any kind, including but not limited to: Diamond, Max Plays and Straight Plays in any form, including their Extended Access versions; Player Props and Player Props VIP; Max Play and Max Play Of The Day; Sharpr Algo (Live or Paper); Kalshi and quant products; recurring subscriptions of any length, including any 2-day, weekly, monthly or annual plan; coaching, calls, add-ons, upsells, bundles, extensions, renewals, trials, free access, giveaways and affiliate or creator comps; and any purchase made with a discount, credit or promotional code. Buying the Lifetime Membership does not extend this guarantee to any other product you own.
• Measurement period: 6 months beginning on the date of purchase.
• The test: your net result across every graded play we sent you during the measurement period, scored at flat 1 unit per play. If that net result is zero or negative, you are eligible. This is the same basis as our public record. Parlays, teasers, alternate lines, different stake sizing and any wager we did not send are excluded from the calculation.
• Your obligation: you must record every play we send in the tracking sheet we provide, and each play must be recorded before that event begins. The record must be complete. A record that is missing plays, or that is filled in after results are known, does not qualify.
• If you do not submit a complete tracking record, you are not eligible for a refund under this guarantee. This is the only documentation we accept.
• What we pay if you qualify. If you paid in full: a refund of what you paid, up to $2,500. If you financed: reimbursement of the financed payments you have actually made, up to $2,000. We reimburse payments made, not payments scheduled, and never more than you have paid.
• Financing is a separate agreement between you and the finance provider. A reimbursement from us does not cancel, pause or alter that agreement, and you remain responsible to the provider for it.
• How to claim: contact support within 30 days of the end of the measurement period and include your tracking record. Claims opened after that window are not eligible.
• This guarantee is void if you resell, redistribute or publish our plays, or if the purchase is charged back or otherwise reversed.
• Nothing in this guarantee is a prediction or a promise of winnings. Sports wagering carries risk and you can lose money. The age requirement in these Terms applies to this guarantee as it does to everything else.

7. Billing Concerns & Disputes

If you have a question or concern about a charge, please contact our support team first so we can resolve it directly. Most issues are resolved quickly.

Because our products are digital and access is granted immediately, we maintain records of account access, billing, and delivery. In the event of a payment dispute, we may provide this documentation to our payment processor to confirm that the Services were delivered as described.

If a dispute is determined to be invalid or fraudulent, we reserve the right to suspend or terminate access to the Services. Nothing in these Terms limits any rights you may have under applicable law or under the policies of your card issuer or payment provider.

8. Not a Gambling Operator

Sharpr Picks (B. Davis Management Inc.) is not a sportsbook, casino, or gambling operator. We do not accept, facilitate, or process bets or wagers. Our content is purely informational. You are solely responsible for ensuring compliance with your jurisdiction’s laws.

9. Age Requirement

You must be 18 years or older to access our Services. If your jurisdiction requires a higher minimum age, you must comply with those laws.

10. Use at Your Own Risk

You acknowledge that DFS and sports wagering involve financial risk and volatility. We are not liable for any losses, financial or otherwise, incurred through your use of our content.

11. Electronic Signature Consent

You agree that your purchase and continued use of the Services constitute your electronic signature and acceptance of these Terms under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act). This consent carries the same legal force as a handwritten signature.

12. Evidence Retention

We retain logs of customer access, billing confirmations, delivery timestamps, and digital access history to demonstrate fulfillment in the event of a payment dispute or legal claim.

By agreeing to these Terms, you acknowledge that this digital record may be used to prove receipt, delivery, and acknowledgment of service in the event of a dispute.

13. Privacy & Data Collection

We collect and process information about how visitors use our website through third-party analytics and advertising technologies, including Microsoft Clarity, Google Analytics, the Meta (Facebook) Pixel, and Whop.com, as well as our own first-party analytics. This may include device, usage, and interaction data collected through cookies, pixels, and similar technologies.

By using our website and Services, you consent to this collection and use of information as described in our Privacy Policy, which is incorporated into and forms part of these Terms. The Privacy Policy also explains the tracking technologies we use and the choices and opt-out tools available to you.

14. Termination

We reserve the right to revoke access to any user who violates these Terms, engages in fraudulent activity, or initiates a false chargeback. No refunds will be issued in such cases.

15. Modifications

We may update or amend these Terms at any time. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
